By using this website, you agree to these Terms. If you do not agree, please discontinue use of the site.

Purpose of This Website

Birthchart Horoscopes provides spiritual, educational, and entertainment tools, including:

• AI-powered spiritual interpretations and conversational tools (e.g., Personal Astrologer chat)

• Paid one-time digital readings (Birth Chart Blueprint, Personal Astrologer, Monthly Forecast, Numerology Daily)
• Premium Membership subscription unlocking unlimited member tools

All content is intended for personal reflection, inspiration, and entertainment.

Eligibility

This site is intended for individuals 18 years of age or older. By using the Service you represent that you are at least 18.

Account & Sign-In

Birthchart Horoscopes uses passwordless magic-link authentication. You will receive a single-use sign-in link by email. You are responsible for:

• Keeping your email account secure (anyone with access to it can sign in to Birthchart Horoscopes)
• Providing accurate registration and birth-data information
• Notifying us promptly of any unauthorized access

Email List & Communications

Some features, such as receiving your free birth chart or member welcome content, involve joining our email list. By subscribing, you consent to receive:

• Transactional emails — purchase confirmations, reading delivery, magic-link sign-in codes, billing notices, and account-related communications. These cannot be unsubscribed from while your account is active.
• Marketing emails — spiritual insights, new tool announcements, and offerings. You may unsubscribe at any time.

One-Time Purchases

Birthchart Horoscopes offers paid one-time digital readings. By purchasing, you agree to:

• Provide accurate payment information through Stripe
• Receive digital delivery in your dashboard at /dashboard/my-readings/ typically within minutes of purchase (some readings require generation time)
• Understand that one-time purchases are personal and non-transferable

Premium Membership Subscription

Premium Membership is a recurring subscription billed through Stripe. By starting a membership, you agree to the following:

• Free trial: New members receive a 3-day free trial. You will not be charged during the trial period.
• Auto-renewal: If you do not cancel before the trial ends, you will be charged the then-current monthly rate (currently $8.00 USD). Membership auto-renews monthly until cancelled.
• Cancellation during trial: Cancel any time during the 3-day trial to avoid being charged. Cancellation takes effect immediately and you will retain access until the trial ends.
• Cancellation after billing: You may cancel at any time. Cancellation stops future charges; you retain member access through the end of your current billing period. No pro-rata refunds are issued for partial months.
• How to cancel: Sign in and visit your account page at /account/, where a "Cancel Subscription" option is available.
• Failed payments: If a renewal payment fails, your subscription will be marked past due. We will retry the payment a few times. If payment is not successfully collected, your subscription will be cancelled and member access will end.
• Pricing changes: We may change membership pricing. Existing members will be notified at least 30 days before any price increase takes effect.

Refund Policy

Because our digital readings are generated using paid AI services and delivered the moment they are produced, the following refund policy applies:

• One-time digital readings: Refunds are available within 7 days of purchase only if a verifiable technical issue prevented delivery (e.g., the reading was never generated, the PDF cannot be downloaded). Once a reading has been successfully generated and delivered, the purchase is final and non-refundable.
• Personal Astrologer questions: Once you have used any portion of your purchased question pack, the purchase is non-refundable.
• Premium Membership: No refunds are issued for the current billing period. Cancel any time to stop future charges.
• Free trial: No charge occurs during the trial. Cancelling during the trial avoids any charge entirely.
• How to request a refund: Email hello@birthcharthoroscopes.com with your purchase details. Refunds are issued at our discretion based on the criteria above.

AI-Assisted Content

Several of our spiritual tools — including Personal Astrologer, Monthly Forecast, Birth Chart Blueprint, Numerology Daily, Lunation Reading, and Premium Birth Chart Reading — are powered by Anthropic's Claude AI. By using these tools, you acknowledge:

• Your birth data, chart calculations, and any questions you submit are sent to Anthropic for processing.
• AI-generated content may contain inaccuracies, omissions, or errors.
• AI content is intended for personal reflection only, not literal prediction or professional advice.
• We retain your reading content and Personal Astrologer chat history in our database so you can return to it.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Submit prompts to AI tools intended to elicit harmful, illegal, defamatory, sexually explicit (involving minors or non-consenting parties), or hateful content
• Attempt to bypass rate limits, question quotas, or access controls
• Scrape, mirror, or systematically extract content from the site
• Copy, redistribute, or resell paid content without written permission
• Use multiple accounts or false birth-data submissions to abuse free tools or trial periods
• Attempt to disrupt, interfere with, or compromise the security of the site
• Reverse-engineer, decompile, or attempt to extract source code

Account Termination

We reserve the right to suspend or terminate any account at our discretion for violations of these Terms, including fraud, chargeback abuse, automation, scraping, prompt abuse against AI tools, or any conduct that harms the Service or other users. Accounts inactive for more than 36 consecutive months may be deleted along with their data, after one notice email.

Intellectual Property

All text, images, birth chart visuals, tarot artwork, branding, design, code, and original content are the property of Birthchart Horoscopes unless otherwise stated. AI-generated content delivered to you for personal use remains licensed for your personal, non-commercial use only. You may not reproduce, redistribute, or sell content without written permission.

DMCA / Copyright Complaints

If you believe content on this site infringes your copyright, please send a written notice to hello@birthcharthoroscopes.com including: identification of the work, the infringing URL, your contact information, a statement of good-faith belief, and a statement under penalty of perjury that the information is accurate.

Third-Party Services

We use third-party services to operate the Service, including Stripe (payments), ActiveCampaign (email), Anthropic (AI), CloudConvert (image rendering), Google Analytics (analytics), and Liquid Web (hosting). These services operate under their own terms and privacy policies.

Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI-generated content will be accurate.

Limitation of Liability

To the maximum extent permitted by law, Birthchart Horoscopes is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service or any spiritual content or readings. Our total cumulative liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Birthchart Horoscopes from any claims, damages, or expenses arising out of your use of the site, your User Content, or your violation of these Terms.

Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict of law principles. You agree that any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Oregon, and you consent to the personal jurisdiction of those courts.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Birthchart Horoscopes regarding the Service.

Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via email to active account holders, and the "Last updated" date above will be revised. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
